Service Terms and Conditions

Costa del Sol Fixers is a trading name operated by Zector Digital Group S.L., CIF B21668744.

A. Parties and scope

These Terms govern services provided by Zector Digital Group S.L. ("we", "the Company"), trading as Costa del Sol Fixers, to the customer ("you"). In these Terms, "consumer" has the meaning given in the Spanish Royal Legislative Decree 1/2007 (Texto Refundido LGDCU). Where you act as a consumer, the mandatory consumer-protection rules of Spanish and EU law apply and prevail over anything inconsistent in these Terms.

B. Requests are not binding contracts

Submitting our Request Help form, sending a WhatsApp message, an email, or speaking to us on the phone is free and does not create a binding contract. Preliminary site visits or photo-based assessments are likewise non-binding unless we agree otherwise in writing.

A binding service contract is formed only when all of the following occur: (i) we have provided a written quotation or service description; (ii) you accept it in writing or by other clear, recorded action; (iii) we confirm the booking or commencement; and (iv) any required deposit is received.

C. Quotations

Each quotation states scope, exclusions, validity period, VAT treatment, materials, labour, any diagnostic or call-out fees, travel/parking/access/disposal costs, and whether the price is fixed or an estimate. Remote estimates based on photographs are indicative and may be revised on site if conditions differ materially from those described.

D. Variations and unforeseen work

We will not perform material additional work without your prior approval, except where it is immediately necessary to prevent serious damage or danger and we have made reasonable efforts to contact you. Variations are documented in writing. Hidden defects, damp, structural issues, asbestos, unsafe wiring or illegal installations discovered on site may require us to pause the work; we will inform you and agree the next steps.

E. Your responsibilities

You agree to provide accurate information; the correct property address; confirmation that you have authority to order the work (including any landlord, owner, community or municipal permission required); safe access; parking arrangements; disclosure of known hazards; access to water and electricity where needed; keys, alarm codes or entry instructions as relevant; availability for approvals; and to protect valuables in the work area.

F. Access, keyholding and remote owners

Where you ask us to hold keys or alarm codes, we will keep them in a reasonably secure manner, log access where appropriate, and return or destroy them on request. Sensitive access information should be shared through secure channels we indicate; we ask you not to send alarm codes through public chat URLs. We do not exclude liability that cannot lawfully be excluded, including liability for negligence causing death or personal injury, fraud, or gross negligence.

G. Subcontractors

We may subcontract all or part of a service to qualified independent specialists. Unless the quotation expressly identifies a different contracting party, your contract remains with Zector Digital Group S.L. and we remain your main point of contact. Where a regulated profession requires the customer to contract directly with the professional (e.g. certain legal or insurance services), this will be made clear before contracting.

H. Regulated work

Regulated work (such as gas, certain electrical installations, energy certification, structural projects, or regulated professional services) is assigned only to professionals or companies legally authorised to perform it. We make no representation that the Company itself holds any licence which has not been expressly stated in writing.

I. Timing and availability

Service dates are estimates unless we expressly guarantee them. Delays may be caused by materials, permits, weather, access, emergencies or third parties. Our messaging about "fast response" and "same-day reply on weekdays" refers to our intent to acknowledge requests promptly during working hours, not to a guarantee of attendance. Requests can be sent 24/7; physical attendance is scheduled by our team and confirmed in writing.

J. Emergency work

Urgent requests are triaged by our team. Attendance is not guaranteed unless expressly confirmed. Emergency rates and temporary mitigation may apply, with permanent repair scheduled separately. For situations involving immediate danger to life, fire, gas leaks, structural collapse or other public danger, you must contact the emergency services (112) directly.

K. Payments

Payment methods, deposits, milestones and final-payment terms are stated in the quotation. Invoices include applicable VAT (IVA). Late payment may accrue statutory interest under the rules applicable to the customer's status (consumer or business). Disputed amounts must be raised promptly. Costs paid by us to third parties on your behalf (materials specially ordered, permits) are charged at cost unless otherwise agreed.

L. Cancellations and rescheduling

You may cancel a request at any time before we confirm a booking, at no cost. After confirmation, we may charge for work already performed, materials specially ordered or non-recoverable third-party costs. For consumers, statutory withdrawal rights apply and prevail (see our Cancellation and Withdrawal Policy). We may cancel a job where access is not provided, conditions are unsafe, the work would breach the law, or the scope cannot reasonably be performed; in that case we refund amounts not corresponding to work already done or non-recoverable costs.

M. Quality, defects and complaints

Please inspect the work on completion and notify any defect promptly. We will be given a reasonable opportunity to inspect and remedy. Statutory conformity rights for consumers (Spanish RDL 1/2007, as amended) apply in full. Manufacturer warranties apply to products supplied. Nothing in these Terms excludes mandatory consumer rights.

N. Photographs and reports

We may take photographs of the work for operational purposes (evidence of condition, before/after documentation, insurance, internal quality control). Any marketing use that identifies your property, family, vehicles or interiors requires your separate, specific consent.

O. Liability

We are liable for direct damages caused by our breach of contract or negligence. To the maximum extent permitted by law, we exclude liability for indirect or consequential loss. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence (where exclusion is unlawful), death or personal injury caused by negligence, or mandatory consumer rights.

P. Force majeure

Neither party is liable for failure or delay caused by events beyond reasonable control (natural disasters, government action, strikes, utility failures, public-health emergencies). Rights already accrued are not affected.

Q. Complaints, applicable law and venue

Complaints can be submitted to hello@costadelsolfixers.es; see our Complaints page for the official Andalusian process. These Terms are governed by Spanish law. Where you are a consumer, the mandatory consumer-jurisdiction rules apply and nothing in these Terms removes your right to bring proceedings in the courts of your place of residence where the law so provides.
